CHARGE AGAINST GERMAN JEWESS THE ALIEN EMERGENCY REGULATIONS [Per United Press Association.] AUCKLAND, November 26. The charge of a breach of the Alien Control Emergency Regulations, 1940, brought against a young German Jewess, Use Katzenstein, in the Police Court on Wednesday, was withdrawn to-day at the suggestion of the magistrate, Mr Orr Walker. His Worship said he had considered the legal points raised by counsel (Mr Terry) and found there was a defect in the proceedings. He suggested that the police withdraw the present information, and added that the case could be heard de novo. The police, however, might consider an adequate warning had been given. Further proceedings would only result in punishing the defendant and would not act as a warning to the public. The police then withdrew the information.
[The defendant was charged that on July 20 last she altered her certificate of registration by crossing out the word “ German ” and inserting the word “ none ” in the space provided for nationality. The police said that Mies Katzeustein, a native of Germany, registered on September 5. At the Ponsonby Post Office on July 20 she notified a caange of address. When interviewed the defendant admitted making the alterations, which she considered she was ■ entitled to. because she was Stateless. Counsel raised a legal point that the defendant could not be charged with an offence allegedly committed in July under regulations introduced in October. The regulations were not retrospective.]
