THURSDAY, AUGUST 3. (Before Mr H. W. Bundle, S.M.) .rUDGMENT BY DEFAULT. .Judgment for the plaintiffs,- with costs, was given in the following undefended cases:—Hugh Rodger (■Ravensbourne) v. John Garvin, £4 17s 7d, balance owing; Brookes and Co. v. G. Kirkpatrick, £4 6s 6d, goods supplied; MMver and Veitch v. J. Storey (Port Chalmers), £G 15s, work done and goods supplied; the Otago Hospital Board v. R. A. Fraser, £3 5s 6d, treatment and X-ray examination; G. F. Bewley and Sons (Macandrew- Bay) v. Herbert W. Pcttengill (Cheviot), £3 7s 4d, goods supplied; M'Cracken and Walls r. Norman Garfield Thompson. £l7 17s 6d', goods supplied; D.I.C. v. W. P. Larsen (Clinton), £1 17s 3d, goods supplied; Walter Russell v. John Clutterbuck (Bavensbourne), £4 3s 3d, balance owing. JUDGMENT SUMMONS. M. Simenauer proceeded against A. A. Campbell claiming £1 10s 6d, with costs (8s), on a judgment summons. There was no appearance of the judgment debtor, and the Magistrate made an order for payment of. the amount, in default two days’ imprisonment, the warrant not to be issued for 10 days. CLAIM FOR DAMAGES. Maurice Edward Armstrong proceeded against the Gold Bond Service Company Ltd., claiming £2O 19s 3d, damages to his motor cycle, and £lO depreciation of the vehicle, as the result of a collision with a taxi at the intersection, of Moray place and Burlington street on April 4. It was alleged in the statement of claim that the driver of the taxi was negligent in that he failed to keep a proper look-out, and to keep as close as possible to the correct side of the road, he proceeded at an unreasonable or excessive speed, and failed to stop, slow down, or steer clear in sufficient time to avoid the collision. The defendant counter-claimed for £3, the value of damage to the taxi, alleging negligence on the part of the plaintiff. The case was still proceeding when the adjournment was taken.
