DRAWING THE AGE BENEFIT
MAINTENANCE ORDER CANCELLED [Paa United Press Association.] WELLINGTON, June 13. Holding that under the Security Act provision was made for the defendant, and that he was no longer a destitute person within the definition of the Destitute Persons Act, Mr A. M. Goulding, S.M., in a reserved judgment delivered to-day cancelled a maintenance orddr and all the arrears owing, on the ground that the defendant was drawing the age benefits provided by the Security Act. The defendant is 68 years of age. The Magistrate Said he did not think the defendant was in a different position from one who received superannuation or pension, except perhaps as to the amount received. In addition to the receipt of the 30s a week to which he was entitled, the magistrate said he must take into consideration that the defendant was entitled to tho medical and pharmaceutical benefits under the Act.
. The complaint was for cancellation of a maintenance order in favour of the defendant against his son. The son complained that the circumstances had changed since the order was made, in that the father was drawing the age benefits under the Security Act and that his own circumstances were such that he was not able to keep up the order. •
