NEGLIGENCE UNPROVED
CASE AGAINST LORRY DRIVER DISMISSED [Peh United Press Association.) WELLINGTON, August 6. A chargfe of negligently driving a motor lorry in Wakefield street on June 24, thereby causing the death of James Keith M'Leavey, was preferred against Walter Owens before Mr J. H. Luxford, S.M., to-day. The deceased’s lorry was struck near the back by another lorry driven by Owens, which, according to the evidence, came round the corner on a left-hand turn. M'Loavey’s lorry, according to the evidence of Cyril William Edser, a companion of the deceased, was standing at 5.15 p.m, with no lights on. M'Leavey wag undoing the canvas cover to jmt a parcel on the lorry. It was raining, and hod been raining all day. Owens came round the corner with his headlights on. Witness shouted out a warning to Owens, but he did not think at the time that Owens might not see them. After hearing further evidence the Magistrate dismissed the case, on the ground that the evidence of negligence was of such a slight nature that no jury could reasonably convict.
