POLICE COURT

MONDAY, APRIL 1. (Before Mr H. W. Bundle, S.M.) BREACH OF FACTORIES ACT. John B. A. Smith was charged with having failed to , pay the wages of an employee at not more than fortnightly intervals, and was fined 10s and costs (10s). A CHARGE DISMISSED. M. Stevenson, Limited, were charged with having on February 1 removed eand from that portion of the Tomahawk Domain under the control and management of the. Tomahawk Domain Board without having first obtained the consent of the board. Mr G. T. Baylee, who appeared foi the board, said he understood that the Marine Department had issued some form of license to the defendant company giving it authority to remove sand from below high water mark.

The. company had large contracts involving the use of sand, and for some time past its employees had been taking large quantities of sand from the beach. It was suggested, however, that, despite repeated warnings not to do so, they had been loading above high water mark. i Evidence as to the permit issued to the company and the locality .from which the sand had been taken was tendered by James Malcolm Stevenson, managing director of the company, who maintained that all the loading had been done within the limits defined by the permit. The magistrate said he could not find that the defendant ’ had contravened the board’s by-laws covering the removal of sand, and dismissed the information. He -suggested, however, that the board should take up with the Marine Department, the question of how- far its fthe board’s) authority extended. MAINTENANCE. Stanley W. Hey was proceeded against by his wife for seperation, maintenance, and guardianship orders on the ground of wilful failure to

maintain. Mr J. G. Warrington appeared for the complainant. After hearing lengthy evidence, the magistrate granted the orders, fixing maintenance at 25s weekly.
