MAGISTRATE CONVICTS KISCH Press Association—By Telegraph—Copyright, SYDNEY, January 21.
Kisch was convicted of being a prohibited immigrant, sentence being deferred until to-morrow.
Following Kisch’s conviction, application was made to Mr Justice Evatt in the High Court for a rule nisi restraining the magistrate (Mr Shepherd) from proceeding further.
Mr Justice Evatt declined to deal with the application until the completion. of the X J olice Court proceedings tomorrow.
The judge, however, granted a rule nisi calling upon the proprietors and the editor of the Sydney ‘ Morning Herald ’ to show cause why they should not be committed for contempt of court respecting the publication of matter tending to prejudice Kisch’ at the recent Police Court proceedings. Argument on this matter was adjourned till January 29 owing to the absence of the ‘ Herald’s ’ leading counsel.
