Mr Justice Ostler to-day .dismissed, with costs against the , the action brought by Samuel Henderson against the printer and publisher ot the Wellington Publishing Company Lt ln his judgment on the nonsuit motion, His Honour said the _ words complained of in the article in Hie ‘ Referee ’ were not capable of a defamatory moaning. The article must bo read as a whole. To say of a man that he should not be allowed to follow his calling because that calling rendered him liable to severe falls, and that, owing to former head injury, such a fail would be dangerous to him, was not defamatory, even if it was untrue. Such a statement might be injurious to him and cause him damage, but it dm not in the least affect Ins reputation, or the esteem in which his lellow-men regarded him.
