WHEAT POOL CONTRACT

INJUNCTION AGAINST MEMBER By consent, an injunction was granted by His Honour Mr Justice Kennedy this morning in a case of importance to participants in the wheat pool. In this case the New Zealand Wheat Growers’ Co-operative Association Ltd. applied for damages for breach of contract and an injunction restraining Andrew Allan, of Awnmungu, South Otago, from selling his wheat crop other than through the plaintiff association. Allan was a member of the plaintiff association, and had agreed, along with a number of growers in the wheat-producing districts of New Zealand, to sell his wheat only through the pool established by the association. Allan bad .sold his 1930 crop other than through the association, and the action was brought to restrain him from selling his future crops except through the pool. Mr H. E. Barrowclough, instructed by Messrs Duncan, Cottrell, and Company, of Christchurch, appeared forth" plaintiff association, and Mr F; BAdams appeared for defendant. His Honour said there would be by consent an injunction restraining tlrdefendant from spiling otherwise than through the plaintiff all wheat pro duced, grown, or harvested by the dr fendnnt from the date thereof until No vein her 31, 1933, on the lands described in the contract referred to in the statement of claim.
