Jn connection with a, recent disturbance at Pongaroa, the magistrate (Mr S. L. P. tree) delivered his reserved judgment yesterday. M. F. Dillon forresisting the police was fined £3; Harry Dillon, for assaulting Constable M‘lntosh, £2; W. A. lie id and I’. Wright, each £1 for obstructing tire police. J'ho defendants were also ordered to pay costs in each instance. The charge against M. F. Dillon that lie was intoxicated while in', charge of a motor car was dismissed, a large number of persons having testified to his so■ricty. The magistrate said be considered that defendant was entitled to me henelit of tire doubt. Just prior to -his arrest the constable obtained the opinion of a prominent settler, who is a justice of tho peace,_ and was standing near. Ho said be did not think the defendant was in a fit state to drive a car. The magistrate said he was satisfied that the constable honestly believed that defendant was intoxicated. He bad reasonable grounds for so doing. It was admitted that M. F. Dillon had had some drink late in the afternoon.
