MAGISTRATE’S COURT

TUESDAY, OCTOBER 6, (Before Mr J. R. Bartholomew, S.M.) SALE ,OF SHEEP. The Magistrate (Dir J. R, Bartholomew) gave judgment this morning in tho case in which Dalgety and Co., Ltd, (Dir H. L. Cook), sued John Johnston (Dir J. B. Callan), on a claim for £29 ss, for thirteen sheep alleged to have been sold and delivered by the plaintiff to defendant at Burnside on June 17, 1925. Ills Worship, after reviewing tho evidence, said that he hold that the sale had been made subject to the con liGous drawn up by the Stock Age V-w and Wool Brokers’ Association, and a copy of which had been duly posted at the yards. Defendant had not troubled _to read these conditions, clauses in which His Worship proceeded to quote. Mr Bartholomew added that ho was satisfied there was an acceptance and an actual receipt; Defendant’s contention that plaintiffs, as agents, had no right to serve him could not be upheld. Judgment would therefore bo for plaintiffs for tho amount claimed, with costs and witnesses’ expenses totalling £ll 9s. UNDEFENDED CASES, Judgment by default, with costs, was given for plaintiffs in tho following cases:—Martin Quirk v. J, H. Wilson (Now Brighton), £3 12s tid, for board and lodging; Richard R. Campbell v. Thomas Dickson, £2O, for groceries supplied; T. E. Sutherland v. 11. H. Simons, 10s 9cl, money lent; A. Ellis and Co., Ltd. v. Robert H. Shields (East Gore), £l3 5s 3d, amount of account stated; Irvine and Stevenson’s St. George Co.. Ltd. v. A. Hunt (Waimate), £0 2s sd, amount of account stated.
