NOTICE TO QUIT SERVED. KAITUNA TENNIS CLUB SEEKS COURT’S INJUNCTION. A dispute which has occurred between a bowling club and a tennis club in Dunedin has terminated in a writ being issued by tho latter to restrain the former from putting into effect a notice to quit tho tennis courts. Tho parties concerned are the ’Kaituna Tennis Club and the Kaitujna Bowling and Lawn Tennis Club Company. .... It is understood that the position, is that the tennis club’s lease expired recently, and that negotiations have been proceeding with a view to having the lease renewed. The Bowling Club Company wrote forwarding a draft lease, setting out tho terms on which it was prepared to grant a renewal. Though tho tennis club at first demurred, it finally _ wrote accepting the lease. Owing to disputes Raving arisen between the two clubs, however, it is understood that tho Bowling Club Company declined to go on with the lease. The tennis club has therefor© taken the matter to the court to obtain an authoritative decision on the question. Tho main action will not _ come on for hearing till the February _ sittings, but it is proposed to ask immediately for an injunction restraining the company from excluding the tennis club from its premiscs in the meantime. It is understood that one of tho main contributing causes of the trouble was in connection with tho playing of tennis on Sunday. The tennis club contends that the refusal of the company to allow the use of tho court for tennis on Sundays is “ harsh and unjustifiable.” Tho matter was mentioned in the Supremo Court this morning by Mr H. L. Barrowclough, who said ho was acting for the club, which had recently received notice to quit its courts. It was alleged that the notice was not valid, and the club was asking the court for an mjunction. The present action was for an injunction, and in due course other remedies would be asked. He was asking immediately for the injunction. His Honor indicated that he could not fix a date of hearing at once, but if the papers were in tho office the matter would bo brought on. Mr Barrowclough said that the writ had been tiled i'i the office.
