LABOR DEPARTMENT’S CASE FAILS. [Per United Press Association.] AUCKLAND, August 14. Mr Poynton, S.M., to-day gave his reserved judgment in. an action by the Inspector of Manes against Andrew Burt, manager of the Pukemiro Coal Company, alleging that defendant had allowed naked lights other than locked safety lamps to be used in the colliery in contravention of the law. After pointing out the danger of coal dust and fire damp, Mr, Poynton said it was not sufficient that there was a probability of dangerous accumulation of gas; it must bo “likely” to occur, and this had not been established. Both cases would be dismissed.
