GISBORNE HARBOR SCHEME
CASH BEFORE SUPREME COURT. [Pee United Puess Association.] GISBORNE, March 23. Th© Supreme Uourt is occupied with tho hearing of an application for a declaratory judgment on the question as to whether tho harbor schcmo prepared by Mr George H. Lysnar contains an dement of novelty. Tho Harbor Board contends it does not, and that therefore it is not liable to pay Mr Lysnar any remuneration in ecoordanco with tho agreement entered into between them. Tho board recently adopted the,.,scheme propounded by Mr Leslie Reynolds, which Air Lysnar claims is practically tho same. Tho proceedings are of a formal nature. _ MV Reynolds was cross-examined at length. He contended that Air Lysnar’a scheme was not novel, as in 1892 ho forwarded to tho Harbor Board a plan which contained the, essential principle adopted by Mr Lysnar. ‘Mr Gerald Fitzgerald, civil engineer, of Wellington, testified that he had’ examined various plans and reports, and had not been able to discover anything novel in harbor construction in Mr Lysnar’s plan. It would nob be possible for anyone to proceed with the. harbor construction on the materia! provided by Mr Lysnar. Tho ease is proceeding.
