MAGISTRATE'S COURT
Tuesday, March 21. (Before Mr J. R. Bartholomew, S.M.) BY DEFAULT. Judgment by default was given for plaintiffs in the following cases:—H. Wise and Co., Ltd., v. W. E. Webb and Co. (Papakura), £7 Is 6d, advertising in directory, ■with costs (£1 3s 6d); Ernest Wood' Messent v. James Kennedy, £7 19s 6d, for clothing supplied, with costs (£l,los 6d) ; same v. Miss M. Kennedy, £5 7s sd, balance due for clothing supplied, with costs (£1 10s 6d:); Stewart Dawson and Co. v. John M. Ellison (Puketeraki), £1 17s 6d, ifor jewellery supplied, with costs (14s); Samuel Bros. v. T. Hitchcock (Pukehaki), £7 8s sd, on account stated*, with costs (£1 15s 6d). ASSESSMENT OF RENT.
Under the Housing Amendment Act John Parkins made application to fix the standard rent on a five-roomed house at 125 Macandrew road, occupied by Henry David Niven..—Mr Callan, who appeared for the landlord, said lie hoped to satisfy His Worship that 15s per week or £39 per year was a fair rental. The capital value of the house occupied by Niven was £4OO in August, 1914. Seven per cent, on £4OO was £2B, and with the insurance and rates it was contended that £39 would be found' a very fair rental. The house occupied by Niven adjoined the house in which Perkins lived.—Evidence was given by the landlord and by Wm. Ross, builder, the latter stating that he considered the value of the place in 1914 to be £4B9.—Defendant stated that the inside of the house was not in good condition; but ho had had no evidence to offer as to capital value.—His'Worship said that defendant had put no ,£viden3e before him, and the evidence on behalf of fcho owner was scant. He thought :!.e values given by experts were often considerably over what was the value. The rent would' be fixed at 14s per week.
