DAMAGES FOR EJECTMENT. A scene at the Hackney Empire Music Hail resulted in an action for damages being brought at the Shorcditrl) County Court (England) by Mr Phillip Curry, dentist, of Dalston lane, against the Hackney and Shepherd's Bush Empire Palace, Ltd., and Mr Bernard Fleming, assistant manager. Plaintiff's counsel said that Mr Curry, after watching the performance at the Hackney Empire for some time, got a pass-out check, and went to the buffet, lie was asked for his ticket in an offensive manner by Mr Fleming, and high words followed. In the corridor he produced the. pass-out. check, and was accused of being a swindler, it being alleged that the cheek was out of date. 'the police were called, and Mr Curry was ejected. Ml' Fleming banged his head against the door, and when outside struck him a violent blow in the eye. For the defence Mr Fleming said that plaintiff became excited when asked for his ticket, greatly disturbing the audience. When he produced an out-of date check it was decided to eject him. Witness was not willing to apologise. To the best of his judgment plaintiff was trying to get in with an out-of-date ticket. Judge Cluer decided that Mr Curry had been given the pass-out check, perhaps by mistake. The. whole trouble seemed to have beecc used by the way he was asked for his ticket. There would be a verdict for £lO 10s damage as to the ejectment and the banging of plaintiff's head against the door. .V separate action would have to be brought with regard to the incident outside.
