(Before His Honor Mr Justice Sim.)

—A Claim for Damages.— William Gerald Manning' v. the Union Steam Ship Company.—Claim, £SOO damages for injuries sustained. The statement of claim set out that on the 28th of July, 1815, plaintiff was working as a carpenter on the troopship Tofua, at Port Chalmers when he fell down the hold of the vessel mid broke his right leg at the thigh. The accident had left him permanently lame. Mr A. S. Ad'ams and Mr B. S. Irwin appeared for tho plaintiff, and Mr A. C. Haulon and Mr C. White for the defendants. Mr Adams explained that the case had been called on this morning so thai the evidence of a. member of the 16th Reinforcements could be taken. It had been arranged to then adjourn tho hearing. George Stanley Taylor, a member of the 16th Reinforcements, who was working on the Tofua at the time of the accident, said that plaintiff went to get a piece of tiniber, when he fjdl down an open hatchwav. The accident occurred about 7.30 in the evenhyr Plaintiff was working at the bunks. There was practically no light over the hatch. Cross-examined, witness said that he only remembered seeing one light about ihe hatchway. Ho was certain that no light was shed on the hatchway. No men with candles were working about the hatchway. Plaintiff was struggling to get out a piece of timber when he stepped back into the hold. ' Flirt her hearing of the case wins then adjourned until the 6th of September. IN CHAMBERS. Moller J.P.s.) Drunkenness.—Peter Kennedy was fmed 12s (including 2s cab hire), in default 48 hours' imprisonment. By-laws.—Thomas Richards, who pleaded not, guilty, was fined 5s and costs for leaving his vehicle unattended.—Richard Tout, for whom Mr Irwin appeared, pleaded not guilty to driving a motor car on the wrong side of the road, and was fined 5s and costs.—Geo. Anderson, for driving a motor car without the necessary red rear light., was lined 5s and costs. —For driving a motor ear at a greater speed than four miles an hour while passing a stationary tramcar, Montague Marriage was fined 20s and costs, the Subinspector stating that the defendant, drove past the tramcar at at least 12 miles an hour.—James M'Kenzie Abernethy, for riding a motor cycle on the footpath in St. Kilda, was fined 10s and costs.—Colin Cardno, for throwing a bottle out of the window of a building to the danger of persons and properly, was fined 10s and costs. Remanded.—Martin Olsen was charged with stealing from a dwelling a suit of clothes, valued >at £6 6s, the property of Edward Fitzgibbou.—The Sub-inspector asked for a remand, which was granted till Monday.
