Dr M‘Arthur, SAL at Wellington, gave judgment yesterday in a ease in which Blouse Lumber, Ltd., of Wellington, sued C. J. Johan, contractor, for £66 for timber supplied to defendant, and as damages for fraudulent representations. The plaintiffs stated that defendant represented to them that ono Oscar Jorgensen had obtained a contract in his own name from one EiUsimmons for the erection of certain buildings at Marital, and that Oscar Jorgensen j required certain timber, amounting to some £65, for the erection of such building; that the plaintiffs delivered the goods to the defendant, but had not been paid by | Oscar Jorgensen, who had now become insolvent, and assigned his estate; that in truth and fact defendant, and not the said Oscar Jorgenson, entered into the before- . mentioned contract, and the timber was used in the completion of such contract by j the defendant, and that the defendant was | paid by Fitzsimmons the contract price for the'same. It appealed that Jorgenson owed pioney to the defendant, and plaintiffs claimed that their materials went to pay Jorgensen’s debt to the defendant. The magistrate said ho believed that Jorgensen and the defendant conspired to obtain materials from the plaintiff's by the j false representation that Jorgensen had j got the Muritai job, and that plaintiffs j supplied the materials believing in and relying on that misrepresentation. Ono of the most interesting features of the fortnightly show tff the Royal Haiticultural Society recently (says a London paper) was a new fruit, which had been ■nven the name of “Hailshamberry." This noveltv has been produced by Mr W. Kni'dit, of Haikham, from the raspberry and°tho loganberry, the latter being itself a hybrid. It is claimed for the nc\v fruit that it is as sweet as the finest raspberry, and entirely free from tho acidity of the loganberry. In appearance and color it resembles’ the raspberry, but differs from it in the way it grows, inasmuch as it spreads itself all over tho branches of the plant, A stead of being confined to ono cane. Its chief feature is that it can to grown out in tho open at this tinjc of the year, whereas tho raspberry season proper has long since gone by. Indignation was expressed at the District Council of Keynsham, near Bristol, at a letter from the Local Government Board declining to sanction the appointn«nt of j the relieving officer.
