Sooular; that he have six months after service to apply to rescind, etc.; judgment costs of all parties out of estate. Same v. Same.—Motion for approval of registrar's report (Mr Sinolair).— Report approved; registrar to report as to remuneration ; costs of all parties out of estate. M'Lachlan v. M'Laohlan and others.— Motion for leave to serve writ oat of colony (Hon. J. MacGregor).—Accordingly. ' Bank of New Zealand v. Walter Guthrie Company, Limited.—Motion to adopt registrar's certificate passing receiver's list and final account (Mr Hosking).—Accordingly. Forsyth and another v. M'Gill and others. —Summons for appointment of David M'Gill as trustee and executor (Mr Donald Reid).— David M'Gill to be appointed, he giving up his right of pre-emption on resigning his office of trustee at least twelve months before the period of distribution; he to receive his present salary till further order without prejudice to any application for remuneration; costs of all parties out of estate.
Same v. Same. —Motion to fix time for filing accounts (Mr Hosking).—Accordingly; costs out of estate.
Re Charles Laverty, deceased. —Petition for direction as to notice to creditors, etc. (Mr Gallaway).—Accordingly > leave to distribute at period suggested. Fotheringham v. Williams.—Motion for leave to serve writ out of colony (Mr Fraser). —Accordingly; time for filing defence, thirty-five days; place for filing defence, Dunedin; sittings of Court for trial next after expiration of above thirty-five days; costs (costs in cause), £2 2a. Re Walter Guthrie Company, Limited.— Motion to settle list of con tributaries as to English shareholders (Mr Hosking).—List settled as filed, except as to M'Leod (struck put) and Lee Howl and Co. and Crosthwaite (reserved for further consideration). Probate was granted re Enphemia Thomson (Hon. J. MacGregor), Maria Money (Mr Milne), William C. Holmes (Mr Holmes), DonaldUrquhart(MrSim),Thomas Lawrence (Mr D. Stewart), and Rose Passmore (Mr Sim). Letters of administration were granted re Annie Cusack, on the application of Mr Woodhonse.
