The appeal is from the decision of Mr Justice Denuiston, and the question is whether, on the construction of the programme of.the First Challenge Stakes by the Canterbury Jockey Club, of which the respondent is treasurer, the appellant, as owner of Loyalty, is entitled to any surplus and forfeits over and above 2,000 sovs, less the amounts payable out of the stake to the others. Justice Denniston gave judgment for the Jockey Club, and Mr O'Brien now appeals. -—■-■■■- -■ - ■■--
