SUPREME COURT.-IN BANCO.
(Before His Honor Mr Justice "Williams) Colonuii Bake of New Zbalahd v. William John Mo.tett (of Invercargill) —Motion to enter judgment for the plaintiff, pursuant to leave reserved, notwithstanding the finding of the jury. Mr Hagititt (with him Mr Dennistan) appeared in support of the motion, and Mr Chapman (with him Mr Salomon) to show cause. This case was tried at Invercargill during the last sittings of the Supremo Court there. The action was upon a guarantee given by the defendant to the Colonial Bank on account of one Reynolds, and the defendants pleaded that certain other terms were agreed upon at Iho time thj guarantee was entered into. At the trial the Judge admitted evidence of the terms alleged to have been verbally agreed upon between the parties, and put certain issues to the jury founded upon the alleged verbal agreement, all of which issues were answered in favor of the defendant. His Honor reserved loive to the p'aintifN to move for judgment notwithstanding these findings, on the ground raised by the p'aintiffs that verbal evidence was not admissible to contradiot a written guarantee, and the plaintiffs moved accordingly.
