CITY POLICE COURT.

Saturday, August 27. (Before G. E. Eliott, Esq., J.P., aud W. P. Street, Esq , J.P.) Drunksnkkaß. For this offence, Joscpli Shepherd was convicted and discharged, and John Kooerico/t fined 10s, or forty-eight hours’ imprisonment Assault. Henry Stevenson alias Harvey was charged with violently assaulting James Thomas In Argyle street, Morningtou, on the 26th inst.—The complainant said that about seven last evening ho went to the accused’s house for an account, but ho refused to pay it, and became abusive. Ho (complainant then left, but was followed by the accused, who struck him on the head with a piece of iron, knocking him down, and inflicting a severe wound. Simon Phillips gave corroborative evidence.—Dr Fer-gius-m said ho waa called on last evening to attend the complainant, whom ho found suffering from a severe wound 1-iin long over the left temple. The piece of iron produced would make such a wound. The accused said that when the complainant called on him yesterday he told him that he could not pay him any money, and the complainant then knocked him down twice.—Three witnesses wore called for the defence, and gave evidence of the accused and complainant's struggling together, aud of the former being knocked down by the latter.—The Bench considered tint the complainant should not have pursued the course he did, and that to some extent he had brought the assault upon himself. They did not consider, however, that the accused was justified in his action, and fined him 20s, with the alternative of four days’ imprisonment.
