Patrick M'Menamin, who was committed for trial by a coroner’s jury on a charge of incendiarism in setting fire to a stable at Makar°ka and causing the death of the entire horse Young Lofty, was examined in the gaol at Invercargill yesterday. Mr T» Macdonald conducted the prosecution, Inspector Fox assisting. A number of witnesses who had given evidence at the inquest were examined, but nothing fresh came light till one James Lyons, who had been in the service of the brothers M’Menamin was examined. He stated that his tent was close to the one in which the brothers lived, and that on a certain night he overheard them concoct ® plan for burning the stable and destroying the horse. James M‘Menamm told' his brother if he would lay bush on the stable, he (James) would do the rest of the business. On the night of the 22ud, a few days after, Lyons heard James get up and go out. He followed him to the stable (nearly three miles away), saw him set fire to it, and knock the horse down with a crowbar.. Mr Macdonald here said he should withdraw the information against Patrick M‘Menamin, and lay another against the two brothers conjointly. This was done, and a warrant issued against James M‘Menamin. He was subsequently arrested and admitted to bail —himself in L2OO, and two sureties of LIOO each. The case is to be gone into on Monday next at the Resident Magistrate’s Court.
