NO RIGHT OF APPEAL
An application by Hohua Alukawa Kino for leave to appeal against the sentence of imprisonment with hard labour for life imposed upon him at Hamilton in May, 1942 for the murder of his step-daughter, Ngahaka Emery, commonly known as Rita Emery, at Otewa, near Otorohanga, has been dismissed by the Court of Appeal. The judgment of the Court points out that no right of appeal exists where the sentence is one fixed by law, as m Kino's case, and the Court accordingly has no jurisdiction to entertain the application. It is, of course, open to the prisoner, if he is so advised, the augment states, to make an application for the exercise of the Royal prerogative of mercy.
