WITHDRAWN FROM JURY
A claim for £600 general damages and £268 6s special damages, brought by Leonard Baddiley, engine driver, of Ngaio, against David Kilpatrick, of Kelburn, was withdrawn from a jury in the Supreme Court yesterday by Mr. Justice Ostler on the grounds of insufficient evidence, and judgment was entered for the defendant. The plaintiff was knocked off his bicycle by the defendant's motor-car when he was riding from the cycle track across the Hutt Road, with the intention of entering the Ngaio Gorge Road at Kaiwarra, on February 24 last.
Dr. O. C. Mazengarb appeared for the plaintiff, and Mr. W. E. Leicester for the defendant.
