CLAIM FOR £1500
HEARING CONTINUED
The hearing of the action brought by Mrs. Louisa Jane Sangster, a widow, of Wellington, for £1500 general damages and funeral expenses against Siegfried Eichelbaum, company manager, of Wellington, for the death of her only son, John Martin Sangster, a bank clerk, aged 21j who was killed when the car he was driving capsized over a bank near Belmont on March 5, was continued in the Supreme Court today before the Chief Justice (Sir Michael Myers) and a jury of twelve. The case for the defendant was opened late this morning.
The allegation of the plaintiff is that the accident was caused by the negligence of the defendant in backing his car and obstructing traffic. There was no collision, Sangster's car leav-' ing the road before it reached the defendant. Yesterday his Honour commented that the car driven by Sangster had changed hands five times in fifteen months before the present o,wner, who was in the car with Sangster, got it for £7 10s. Counsel for the plaintiff said there was no question of the car not being fit for the road.
Mr. Q. C. Mazengarb is appearing for the plaintiff, and Mr. G. G. G. Watson with him Mr. Shorland, for the defendant.
