NEW ACT INVOKED
INDICTABLE OFFENCE
For the first time in Wellington advantage has been taken of section 41 of the Statutes Amendment Act, 1936, which provides that any person who has pleaded not guilty on an indictable offence in the Magistrate's Court and has been committed to the Supreme Court for trial may, if he wishes to change his plea to one of guilty, apply to the Supreme-Court to have his case dealt with instead of waiting for the next criminal session.
Appearing before Mr. Justice Ostler, Patrick George Kubler, a grocer's assistant, aged 22 (Mr. C. H. Arndt), who had previously made application, reversed his former plea of not guilty to two charges of obscene exposure and was admitted to probation for two years.
