ASSAULT BY DRUNKEN MAN

An affray which took place last night had its sequel in the Magistrate's Court this morning when Kenneth Sullivan, a labourer, was charged before Mr. W. F. Stilwell, S.K., with assaulting James White yesterday, and also, with being drunk in Willis Street.) Other charges were brought against I him later. ! James White gave evidence that the j accused, who was in a drunken condition, came into the place where witness was employed, and asked for his (accused's) sister, who was employed as a waitress. Witness took a message from her to the accused that she would see him outside at 7 o'clock, As they were going down the stairs the accused struck witness on the mouth but the custodian, who happened to be near, grabbed the defendant's arms and held him. They put the accused out on the street, but the accused struck witness again in the face. His suit' was torn. The custodian gave corroborative evidence. : ' ' The accused was charged also with assaulting Peter Douglas King on November 1, and with damaging King's car to the extent of £2 by tearing the curtains. Kathleen King said she was the sister of the accused. At about 7.15 p.m. the night before last she was to have met the accused, but she was late, and when her husband called in the car, the accused, who was drunk, tore the curtains of the car and hit King in the face. The accused was all right when he was sober.

Peter. Douglas King said he called for his wife, who met him and said that her brother was there and was drunk, and to drive on. The accused hit him and damaged the car, and witness later laid charges.

The accused, when questioned by Sub-Inspector C. E. Roach, said he would not have hit King if he had been sober.

On' the first charge of assault the accused was fined £5, in default one month's imprisonment, and on the other assault charge he was convicted and ordered to come up for sentence if called upon within 12 months. On the charge of damaging the car he was ordered to make £2 restitution, and he was convicted and discharged on the drunkenness charge.
