A case was recently argued under the auspices of the Wellington Law Students' Society before Mr. Lan Macarthur, • LL.M. The facts of the case disclosed that Alpha, the owner; of an aeroplane, had been seriously injured in a crash which had occurred as a result of the negligence of Beta, the pilot of the machine. Gamma, a bystander, had also suffered injuries. Actions in tort were brought, against Beta by both Alpha and Gamma, and it was assumed that the Court of Appeal had given judgment in favour of Gamma, but ■ had non-suited Alpha. The present case was argued as if on further appeal to the Privy Council.
\ After counsel on both sides had been heard, Mr. Macarthur delivered judgment. He' dismissed the first appeal, but allowed Alpha's action againsi Beta. He pointed out that the Privy Council was not bound by its own decisions.
