A THIRD OFFENCE INTOXICATED DRIVER "In spite of all that has been said by counsel, I fail to see that there are any mitigating circumstances in this case," said Mr. J. H. Luxford, S.M., in the Magistrate's Court today, after hearing the circumstances in the case in which Teodethero Garbes, a labourer, aged 42, was charged with being found intoxicated in charge of a motor-car in Queen's Drive on December 25. Sub-Inspector J. A. Dempsey said that the accused had borrowed his brother-in-law's car and was driving towards Island Bay when he collided with another car. The other driver had seen the accused on the wrong side of the road, and his car was almost stationary when struck. The accident occurred at 10.15 p.m., and at 11 p.m. the accused was examined by a doctor and pronounced unfit to drive. He had been convicted of similar offences in 1926 and 1935, in which cases fines were imposed. Mr. M. G. Neal appeared for th« accused. The accused was sentenced to a month's imprisonment, his licence was suspended until May 31, and he was prohibited from obtaining another for a year.
