£5000 FOR A FOREARM
Mr. Justice Greaves-Lord, in the King's Bench Division, recently gave his decision regarding the liability for £5000 damages awarded to James Stuart Benedict Olsen, 18, of Radnor I Road, Harrow, who lost his right forearm following an accident at Gravesend Aerodrome, when he was struck by an aeroplane propeller that he was swinging. Olsen, who was an apprentice at the aerodrome, sued William Heath Corr^ of Yeldham Manor, Kernsing, Kent, pilot of the aeroplane, and Gravesend Aviation, Ltd. When r the case was before: him last • term the Judge found that there was negligence by both Corry and the company, but ho reserved judgment on the legal question as to whether the company was exempt from liability by reason of the terms of Olsen's apprenticeship deed. Giving judgment, Mr. Justice Greaves-Lord said the deed was so wide in the extent that it purported to- relieve the company from liability that :t was not for. the benefit of Olsen, and was therefore void. Mr. Justice Greaves-Lord gave judgment for Olsen for £5000 against both Corry and the company, and granted a stay of execution, pending a possible appeal.
