PLAINTIFF SUCCEEDS

"I have never come across a case of a builder who was as easily persuaded to do very much more than he was called upon to do," remarked Mr. Justice Blair in the Supreme Court this afternoon, when he gave judgment for £516 4s 4d in favour of Wilfred Ernest Jones, builder, against Philip Henry Miles, and his wife Jeanne Miles. Jones claimed £521 in respect of a building contract to erect a house for the defendants in Te Anau Road, Hataitai.

His Honour said the plaintiff had not only given the defendants full value, but more than full value. Nevertheless the defendants came along with what merely amounted to a highly technical defence to the claim. His Honour thought the claim should never have been defended at all. It seemed to him, however, that on the evidence he would have to make some reduction in respect of the claim. If he allowed £5 off the claim he thought he would be doing more than ample justice for the defendants.

Mr. W. E. Leicester and Mr. W. B. Rainey appeared for the plaintiff, and Mr. H. McCormick for the defendants.
