COMPENSATION CLAIM
£1000 AWARDED
The hearing of a claim by Jessie Smart against the Wellington Publishing Company for compensation for the death of her husband, Andrew Smart, was continued in the -.Arbitration Court yesterday afternoon. Andrew Smart was a compositor employed by the defendant .company. On or about September 29, 1932, he fell down a flight of' stairs .and bruised the little toe of his right foot. ' The toe became septic and was amputated. Subsequently the leg had to bo amputated above the knee owing- to the spread of the septic or gangrenous condition. Smart died on June 14, 1933. Plaintiff claimed £1000 compensation, £50. funeral and medical expenses, and costs._ After hearing medical evidence, his Honour Mr. Justice Frazer said_ deceased suffered • from arteriosclerosis,; or thickening of the walls of the arteries, which would delay the cure of such an injury as had -been sustained, even a slight injury. , His Honour referred to the medical testimony.-as to the spraad of gangrene or the septic condition, and said that it was the opinion of A majority of the Court that the plaintiff was entitled to full compensation, and judgment was giv'eiivaccordingly.
