YOUTH'S DEATH
MOTORIST ON TRIAL
ALLEGED NEGLIGENCE
(By Telegraph.—Press Association.) AUCKLAND, This Day,
Noel William McColl (23), stationer, of Otorohanga, is on trial in the Supremo Court today on a charge of negligently driving a car so as to cause tho death of a youth, David Ellis, at Takapuna, ou May 7. Ellis was found dying on the road on a dark rainy night, and the Crown alleges that he was struck by McColl's car.
The Crown called as a witness the accused's sister-in-law, Anne H. Roberts, who said that the accused and his wife and child were in the front of the car and witness in the back. Passing through Takapuna her sister suddenly became very excited and seemed frightened. Witness thought that her sister said excitedly, "Go on." "Wo seemed to be all talking at once," continued the witness. "My sister seemed frightened as though we might have struck something. I don't remember what the accused said. After a While I think my sister said, 'Noel, I think we hit something.' I felt the slightest sort of brushing,; but no impact." In answer to many of the prosecutor's questions the witness said she could not remember, and his Honour _ finally remarked, "Is it worth while, Mr. Meredith?"
