WILLIE TONG NOT TAI SING

(By Telegraph.—Press Association.)

AUCKLAND, This Day.

Willie Tong, who served four days in Mount Eden Prison, is hot Tai Sing. This much was decided.by Mr. Justice Eeed this morning, when he ordered Tong's release. One counsel said that the position seemed to be that Tong, for a long time, had been carrying on as Tai Sing, but he had no evidence to offer.

Counsel for the Chinese said he had. a,witness to prove that Tong was not Sing. The Judge said the defendant had behaved in an absurd way. The. amount involved in the debt proceedings was only £8, and, although the papers had been wrongly served on him, he allowed proceedings to go on, and actually, Went to gaol.

The Judge refused to grant costs against the persons who had the defendant imprisoned, but said if an action was taken for damages for wrongful imprisonment, costs could, then, be added. . ' •■--..-_
