TAXI-DRIVER- IN. TROUBLE

, Found slooping in a doorway in Newtown by Constable Gillum early yesterday morning, a taxi-driver, Percy John Heat, aged 26, became abusive, when tie constable woke him up. , His conduct led to hia appearance before Mr. E. Page, S.M., charged ■with- using obscene language and with resisting the constable-while- in the execution of his duty. ■ . Through his counsel, Mr. P. M'Carthy, Heat pleaded not guilty. -. v , In ovidence the constable said that •ho was going away after waking the accused up when Heat became abusive and used bad language. He was then arrested. A friend of the accused's came along and the accused took off his coat, and, handing it.to his friend, offered to fight the constable.,/ Witness refused the invitation an,d -took Heat along, to the Mount Cook Police Station, but on the way there the accused attempted to. escape and had to be handcuffed. ■ ■ ' , . Heat denied ever using the language and attempting to escape. ,'He had just suggested that they should take a short cut through the Basin Eeserve to the police station, but the constable had preferred the other way round and had handcuffed him. He had been to a party that" night and had had a few drinks. The Magistrate: "How many drinks did you have I" The accused: '.'About three or four." The Magistrate: "How many is that?" , . The accused:. "Well, I didn't keep count." "I accent the evidence of the constable as being substantially the true version of the affair," said Mr. Page in convicting Heat. Sub-Inspector Ward said that the police report was that the accused was known to them and he was regarded as a larrikin and a, bully. Heat was convicted and discharged for using the language and fined £2 for resisting. He was allowed a fortnight in which to find the money.
