Whatever legal justification there may be for refusing to treat the Hult road as -a main highway,, the facts certainly do not warrant the Main Highway Board's refusal of a maintenance subsidy. The board has advised that, in view of special payments made under the Finance Act, 1927, there does not appear to be any justification for' declaring the road a v main highway. But these special payments are to cover loan charges, and are in commutation of the fees formerly collected from users of the road. The City and Suburban Highways Board has been deprived-of those fees, and has been compensated by special grants to cover the loans raised in expectation of the fees. This, however, does not in any way disqualify the board from claiming the subsidies available for maintenance. The road is a main highway if ever there was one, and it is reasonable that it should have the grants made to other main highways. Withholding them can be interpreted as nothing but an attempt to withhold from the city motorist his rightful .share of the funds provided by his taxation.
