BETRIAL GRANTED

A BANKRUPT BUILDER

AUCKLAND, 20th. May.

Leave to apply to the Appeal Court for a retrial was granted to. Clarence William Bruce, builder, of Auckland, by Mr. Justice Smith! in a judgment delivered at the Supreme Court.

■ At the present criminal sittings, of the Court, Bruce was found guilty of failing to keep proper books, with i.in-' tent to :conceal the true state of his affairs, and of failing to keep proper books within three years prior to his bankruptcy. When the .of -the jury was returned, accused's counsel admitted that he could take. no" objection to ■ tho verdict-on the second count, and on that issue* the prisoner was sentenced to three months' imprisonment, without hard labour. With regard to tho first count, however, Mr. Jordan moved for leave to appeal to. the Court ,of Appeal for a new trial on the ground that the verdict was against tho weight of evidence.
