FINED FOR THEFT
The case in which Rudolph yon -Gruber, a Hungarian, was charged in the trate's Court on Friday with the theft of held glasses and other articles was disposed of this morning. Mr. E. Page, S.M., who heard the evidence, said lie had given the matter careful consideration, and had perused all the correspondence connected with the case, which had been fairly voluminous. On the charge of theft ot the held glasses be proposed to convict Yon Gruber; the other charges he proposed to dismiss. Yon Gruber, from ttie dock: "Your Worship you will excuse me. I can prove that I did not steal those glasses." He stated that be would like trial by jury, but it was pointed out that lie had already elected summary trial. Counsel for the. accused, Mr. D. Foster, said that yon Gruber, since his arrival in JSew Zealand, had borne a good character. He had been in custody from sth Uecember, the date of his arrest at Auckland. _ Counsel suggested that the accused might be convicted and discharged, or admitted to probation. The Magistrate fined Yon Gruber £2, and ordered him to pay expenses, £5 18s, in default one month's imprisonment. A iortnight was allowed the accused to pay the nne. ./
