A FEATHERSTON CASE

Mr. Justice Blair was engaged In the Supreme Court yesterday in hearing ,a case concerning a bridge in the Featherston County. The plaintiff was -the Featherston County Council, and the defendants were the Public Trustee as the executor of the estate of the late George Hume, of Pirinoa, sheepfarrner, and the Guardian Trust and Executors Company of New Zealand, Ltd., as executor of the estate of the Jate William Hume", also of Pirinoa. The facts were that George Hume constructed a road near Featherston to open up some of his property. The road was not finally approved by the council before completion, and it was subsequently ascertained that certain requirements had not been complied with. To overcome the difficulty, a bond was entered into by George Hume, whereby he undertook to rebuild any N bridges ' which did not sustain a specified load. William: • Hume entered into the bond as a guarantor. The road was ultimately taken over by the epuncil subject" to the requirements of the bond being fulfilled. One of the bridges did not give satisfaction, and the parties applied to the Court to determine the type of bridge which the trustees of the George Hume estate were bound to build to replace it. ' The hearing of the case was adjourned until 12th December. Mr. P. B. Cooke, with him Mr. H. R. Biss, appeared for the plaintiff, and Mr A. Gray, K.C., with him Mr. H. E. Evans, for the defendants.
