I AN ENGLISH JUDGMENT A judgment of importance" to motor dealers and purchasers was delivered in England recently in a test case. It concerned the description of a car. The machine was sold as a 1923 model, but was manufactured in September, 1022. The purchaser later .discovered this, and claimed that the car was not as described at tho Jhno of purchase. Motor trade experts of the highest standing were called, by both sides, and their evidence showed wide diversion on what they understood as to the meaning of th term "year of manufacture." It was not denied by the plaintiff that the car was any different from others of the same- make manufactured early in 192.''.. The defendant claimed that year of manufacture- in the "motor trade meant from about tlio period of one annual motor 'show (Olympia) to tfcc next and that tho "1023 model" meant the type manufactured for that period, even though turned out of the-factory before Ist January. The' Judge, Mr. Justice Talbot, rejected the defendant's contention, and found for the plaintiff, awarding damages accordingly. He stated that a car of any stated year must have been manufactured in that year.
