AVON BRIDGE CASE

LEAVE TO APPEAL GRANTED

Leave jo appeal to tho Privy Council was given by the Court of Appeal to-day m the Christchnrch bridge case. Tho facts relating to tho appeal are as £ollow:-Tho New Brighton Bor° ough Council proposed replacing an existing bridge over the river Avon with a concrete bridge, which would have a clearance of four feot at high water, itichard Bcdward Owen applied to the Supreme Court for an injunction restraining tho council carrying out the work on the ground that the bridge would hinder navigation of the river by pleasure craft. Mr. Justice Stringer granted the injunction. His decision was reversed by the Court of Appeal, Mr. Justice MacGregor being tho di3sonting Judge. Tho other members vi the Court were the Chief Justice (Sir Charles Skerrett) and Mr. Justice Sim. Sir Charles Skorrett, Mr. Justice MacGregor, and Mr. Justico Alpers sat to-day to considor motions to vary the judgment in respect of costs, and for leavo to apply to the Privy Council. After hearing Mr. G. G. Watson for Owen, and Mr. A. Gray, K.C., with him Mr. J. Hanna, who appeared for tho council, tho Court granted tho leave to appeal asked for. It was ordered that tho applicant should find security of £500 within two months, and that tho record should bo dispatched to England within three months. Tho motion to vary costs is to be considered at a further sitting of the Court.
