A SURPRISE VICTORY

(By Telegraph.) (Special to "The Evening Post.") AUCKLAND, This Day. The story of the horse called-Long I Shandy was unfolded at Whakatane yesterday before. Mr. W. G. K. Kenrick, S.M., when Joseph Ker, a barman, claimed possession or £60 value from Robert Ashby, licensee of the. Taneatua Hotel. The plaintiff also claimed £10 damages for alleged wrongful detention. The plaintiff said that he purchased the horse at Opotiki. The defendant entered the horse for the Maiden Scurry at the Taneatua Meeting in last March, and it won, to the surprise of most of the racing enthusiasts. The plaintiff was employed as a barman. The defendant asked him to allow it to be entered for a race in his (Ashby's) name, and he would call him Long Shandy. The original name was Sultan. The Magistrate: "Was it thought that he would go faster with the name Long Shandy?" (Laughter.) j Plaintiff: "The horse won the race." The Magistrate: "Was a good dividend paid on it?"

Counsel: "There is no totalisator at Taneatua."

„ Plaintiff said that he bought the horse for £5, which he borrowed from the defendant. Later he paid £2 10s, back and arranged with the latter to race the horse. The plaintiff left the employ of the defendant, and demanded the horse fom Ashby. The latter refused delivery.

T. Mitchell, junr., a farmer of Taneatua, valued the. horse at between £6 aiid £8. Jt was anything from 12 to 14 years old. In his opinion the horse should not have won a race at Taneatua. ■ The Magistrate: "I understand the horses hide behind a maize patch on the course." (Laughter.) Witness: "Yes." T'e Magistrate held that Ashby had commissioned Ker to purchase the horse, and gave judgment accordingly for the defendant.
