PROPOSED SCHEME

WHAT THE LAW REQUIRES

The procedure to be adopted by local authorities in the preparation of their town-planning schemes, as required under the legislation of last session, is prescribed in regulations under the Act which were issued in a '' Gazette published last night. Every borough council that is required by the Act to prepare a townplanning scheme will be obliged to prepare a civic survey map—unless existing maps contain the necessary particulars—showing, inter alia, the position of all streets and private streets the names, widths, and surface levels being stated; the routes of tramways, railways, and licensed motor omnibus services; the position of any harbour or other waterway, showing all wharves, etc.; reserves and other open spaces^ with particulars as to their purposes • areas of Crow.n laud and of Native land; land with buildings thereon, with particulars as to the kinds of buildings (for example, residences, shops, factories, public buildings, or as the case may be); the several allotments into which the land within the borough is divided. ''

A provisional town-planning ■ map is also required to be prepared, showing all works proposed' for the purposes of the town-planning scheme, including new streets, street widening and deviations proposals, proposed building lines, recreation grounds, particulars as to density and height of buildings, etc. A statement is required explaining the proposals on the map. Together with a copy of the local bylaws so far as they may affect the operation of the scheme, and any proposed new bylaws, the documents prepared must be forwarded to the Town-planning Board, which may require the council to make modifications or alterations in.the proposals.

Objection to the scheme may be made by the occupier of any rateable property within the borough, and the owner who is not the. occupier, while other persons interested may make written representations. Within three months from the first public notification of the scheme, the council_ will submit to the board copies of the notification, objee: tions, and representation received, and any recommendations made by it. On the final approval by the board of a town-planning scheme the borough council will prepare a map to be known as the approved town-planning map, which, together with a final explanation of proposals, will be prepared by the council for the use of the board.

The provisions of the regulations will, with, necessary modifications, apply to regional planning schemes and combined town and regional planning schemes. ■ '■
