i GISBORNE, This Day. The trial of John Sullivan, charged with the murder of Jeremiah Williams, near Opotiki on Ist December is proceeding. The Grand Jury found a no bill against Garnet Wolseley M'Minn, who was indicted at the Supreme Court this morning on a charge of murdering Robert Cecil Thelwall, who died from injuries received after being struck by M'Minn, and falling on the pavement. Mr. Justice Ostler said that it was doubtful if M'Minn could be sent for trial on any charge, let alone murder. The evidence showed that the accused had been thrice struck by Thelwall without retaliation. He had finally struck the deceased a light blow, but it was doubtful whether the fall wafe caused by the blow or by the deceased stumbling.over the kerb. To proceed with the trial would not only be a waste of time to the Court, but also an outrage to the accused.
