In order to test tho validity of the recently-passed Newspaper Tax Act, a writ has been issued out of the High Court, on behalf of the "Sydney Morning Herald," the "Daily Telegraph," the "Sun," and the "Evening News," claiming a declaration that the. Act is invalid, being inconsistent with the provisions of the Commonwealth Constitution. . Plaintiffs ask for an injunction restraining the State of New South Wales and the Colonial Treasurer frcm proceeding to enforce the Act. They will on Tuesday next, the first day on which the Court opens, file notice of motion asking for an interim injunction in accordance with the claims in tlu writ. The four newspapers have engaged leading counsel to appear in the case.
