CARRYING CONTRACT
RESULTS IN COURT ACTION.
Mr. Justice MacGrogor was engaged at the Supreme Court yesterday in hearing a disputed action in which Melville D'Arcy Heath Wilkcns, of,Ngaio, carrier, proceeded against Jane Williamson, of Wairoa, claiming £107 iv connection with a carrying contract. Mr-, W. E. Leicester represented plaintiff, and' Mr C. G. White appeared for defendant. The claim was made on the ground that defendant contracted with plaintiff to move a certain amount of furniture to Wairoa from Wellington. On the date the removal was to commence the defendant s agent refused delivery in Wellington and the removal was delayed. Plaintiff alleged that no then bad to carry considerably more than the amount of furniture contracted for IJ O claimed £50 for work let out which he could have done nurin<*. the nrrinrl nf delay. £50 for'the extra lorry tenured and £7 for money held back ■ '
an allegation that defendant's' Ton made arrangements without her consent and lor which she denied liability The case was heard in the Supreme Court ovnng lo the third party procedure having been involved, and there being no provision for this except in the Supreme Court. l
After bearing evidence l,i s TTononr entered judgment for plaintiff f or £67 with costs.
