AN UNFORTUNATE CONFUSION.

An application by the Law Society that the name of Lawrence Jamee Prendegast, a solicitor of Auckland, be struck off the rolls was- to-day considered by the Court of Appeal, consisting of his Honour th« Chief Justice (Sir Robert Stout), and their Honours Mr. Justice Sim, Mr. Justice Adams, and Mr. Justice Ostler. .'

There was no appearance of the respondent, who, according to the society's representative (Mr. Jl. yon Haagt) was at present serving a term of three years' imprwonment. Mr. Justice Sim remarked that' respondent could not very well have^ anything to gay jf he was in prison. r The Court granted the application, with £15 15s costs.

Mr. yon Haast remarked on the unfortunate confusion wh"ic|l had arisen between the name of the respondent and that of Mr. E. J. Prendegast, who wm present in Court. The latter was a well-known and high-respected member of the Bar.

Mr. Jtutice OB«er observed that the Court well knew the respondent was not a relative and had absolutely no connection with Mr. E. J. Trendegast.

ANOTHER APPLICATION. A similar order, thtt the respondent's name be struck off "the rolls, was made in the case of George William M'Caul, of W»ng»nui. Reipoudent was 'not represented by.'counsel, and the usual order was made as to costs.
