A SHIPPING CONTRACT
DAMAGES FOR BREACH.

SYDNEY, 13th June. In the Banco Court John White secured a verdict for £540 against Davis trelatine of Australasia, Ltd., for an alleged breach of charter-party. The plaintiff, who claimed £3500 damages, stated that it was agreed by the charter-party that the defendants' ship, the H. K. Hall, then at Lyttelton. should proceed to Maiden Island to load a cargo of guano, which would be taken to New Zealand and delivered on payment of the freight. The allegation was that defendant failed to carry out the agreement. Defendants pleaded that they did not agree, as alleged, and were prevented from carrying out the agreement by-dangers and perils, of ° the sea. A stay of proceedings was granted.
