Murray {.claimed £97 10s for losses caused through l\he killing in October, 1923, of 29 ewes,. ilO lambs, and one wether, by dogs alleged to be owned by Jtlrs. Tristram. •Daring the •hearing it was admitted that one of the dogs killed by plaintiff was owned by defendant, and it was proved that the other belonged to one :■ Smith, who resided and kept his dog at Mrs. Tristram's house. > ; The Magistrate held that although it vhad been shown that one of the dogs beilonged to the witness Smith, he thought {Mrs. Tristram was liable for the damage | done by the dog, as she was the occu- : spier of the premises where it was usually permitted to . remain. .Plaintiff that the dogs were seen worry■iiiiT his sheep, and were shot by him the shext morning. "I think," said the I Magistrate, "the facts point to the whole ;pf the-damage being done by the dogs ?iwhich plaintiff shot, and for that damfage Mrs. Tristram must be held liable." j * Judgment for £84 was accordingly entered against the defendant' Tristram, I •and also against the separate estate of !!Mrs. Tristram. ■| At the hearing Mr. A.
