DISMISSAL OF APPEAL,

A motion to have set aside a-judg-ment of his Honour, Mr. Justice Stringer, delivered at Auckland in ; regard- to certain legal costs was considered to-day by the first division of the! Court of Appeal, consisting of his; ;Honour, the Chief Justice (Sir Robert Stout), and their Honours, Mr. Justice Salmond and Mr.' Justice Sim. • ■ Mr. G. Hutchison appeared for the appellant, Ernest Taniwha Sutherland, and the respondent's, Gordon J. C- Bennett and Clifford M. N; Jacobserf were represented by Mr. T. J. Flemming. His Honour, Mr. Justice Stringer, in the Supreme Court, ' dismissed, the motion to review the taxation; on all'points. The facts were that the respondent firm, practising in Auckland, , was ..retained by the appellant to act. for him ;m legal business, included in which was | the raising of a.loan.for-£2500.upoa- the security of a .first mortgage of , £3600. held by Sutherland over certain lauds.
